General Terms and Conditions for the Performance of Work on Vehicles, Vehicle Parts, and Other Objects, Offers and Orders of the Partner Company Performing the Work in its Role as Partner of P1coatings.com.hk (Version 11/2023)

1. Scope of Application

These General Terms and Conditions (“GTC”) apply to all works carried out, offers made, and orders placed by the partner company in its capacity as a partner of P1coatings.com.hk. The partner company and the customer will hereinafter be referred to as the “Parties”.

2. Service Agreement

The customer agrees to the following terms and conditions upon engaging the partner company’s services. The service agreement becomes effective upon the customer’s acceptance of the work proposal provided by the partner company.

3. Price and Payment

Prices for services are as stated in the offer. Unless otherwise agreed in writing, payment is due immediately upon completion of the work.

4. Completion of Work

The partner company will make every reasonable effort to complete services within the timeframe agreed upon. However, due to circumstances beyond their control, delays may occur. In such cases, the partner company will notify the customer as soon as possible.

5. Warranty

The partner company warrants the quality of the work performed and the materials used for a period of one year from the date of completion of the work.

6. Liability

The partner company’s liability for any damages arising out of or in relation to the services provided is limited to the value of the services provided.

7. Intellectual Property

All intellectual property rights in any work product resulting from the services provided by the partner company remain the property of the partner company, unless otherwise agreed in writing.

8. Dispute Resolution

Any disputes arising from or in connection with these GTC shall be resolved amicably between the Parties, and if not possible, through legal proceedings at a court of competent jurisdiction.

9. Governing Law

These GTC and the relationship between the Parties shall be governed by and construed in accordance with the laws of the jurisdiction in which the partner company is located.

10. Modifications

These GTC may be modified by the partner company at any time. Any modifications will be communicated to the customer and will apply to works undertaken by the partner company following such notification.

11. Severability

If any provision of these GTC is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

12. Entire Agreement

These GTC constitute the entire agreement between the Parties with respect to the subject matter hereof and supersedes all prior and contemporaneous agreements, understandings, negotiations, and discussions.
